Successfully represented ERC Holdings in first case on disclaimer of equitable interests under Singapore law

Partner Vikram Nair and Senior Associate Foo Xian Fong from Rajah & Tann Singapore successfully acted for ERC Holdings in a case that involved a broad ranging inquiry into the law of trusts, and in particular, the principles applicable to constituting various types of trusts and disclaimer of equitable interests. This was an application for interpleader relief by Mr Ho Yew Kong who was holding around 1 million shares in a company called GREIC and had claimed he was holding these shares on trust for Mr Douglas Foo while Mr Foo had denied this multiple times. After court proceedings, Mr Ho intended to transfer these shares to back ERC Holdings since Mr Foo had denied they were held on his behalf. This case is the first case on disclaimer of equitable interests under Singapore law.
