Rajah & Tann Singapore Contributes to Chambers and Partners Global Practice Guide: Child Relocation 2024 – Singapore Trends and Developments

Rajah & Tann Singapore recently contributed to the Singapore chapter of the Global Practice Guide: Child Relocation 2024 published by Chambers and Partners.

Singapore has become home to expatriates who have chosen to stay in the country for some time for various reasons, including work and education. An area of law that would significantly impact their lives is the law on international relocation of children. Authored by our Family Law specialists, Partners Kee Lay Lian and Yoon Min Joo, Senior Associate Shawn Teo and Associate Yvette Tay, the chapter seeks to provide an overview of the significant case development in Singapore on the international relocation of children in the last decade since the seminal Court of Appeal decision of BNS v BNT in 2015. The authors noted that prior to BNS v BNT, the Singapore courts’ primary consideration in allowing the relocation of children was the reasonableness of the wishes of the relocating party. The judicial attitude towards granting applications for the relocation of children has since shifted with the ruling of the Court in BNS v BNT, where the Court adopted a holistic approach in assessing whether the relocation would be in the best interests of the child.
