Second Phase of Regulatory Development on the Simplified Business Registration
On 26 May 2026, the Ministry of Commerce issued Prakas No. 044 MOC.BRD.PrK on the Simplification of Business Registration Phase II (ʺPrakas No. 044ʺ). The purpose of Prakas No. 044 is to continue the simplification and modernisation of business registration process, building upon Prakas No. 117 MOC.BRD.PrK on the Simplification of Business Registration dated 9 December 2025.
The key features of Prakas No. 044 include the following:
- identification of commercial enterprise legal forms;
- clarifications on the filing process relating to (i) business objectives; (ii) filing of the memorandum and articles of association; (iii) registration of local branches; (iv) filing of company secretary’s information and annual declaration of commercial enterprise; (v) data management of companies; and (vi) dissolution and de-registration; and
- removal of administrative complaints.

New Regulatory Developments on Elevator Use and Installation in Cambodia
In early 2026, the Ministry of Land Management, Urban Planning and Construction (“MLMUPC“) issued two significant Prakas aimed at strengthening regulatory oversight, safety standards, and accountability in Cambodia’s construction sector.
On 29 January 2026, MLMUPC issued Prakas No. 008 DNS/K.K.C/PRK on Certificate of Elevator Use (“Prakas No. 008“), establishing a comprehensive regime governing the certification, continued use, and compliance obligations relating to elevators across both construction and non-construction contexts. This was followed by the issuance of Prakas No. 033 DNS/PRK/K.K.C on 31 March 2026 on Licence for Elevator Installation (“Prakas No. 033“), establishing the conditions and procedures for the issuance, suspension, and revocation of the licence for elevator installation. Both prakas came into operation upon their respective dates of issuance.
This Update highlights the key features of Prakas No. 008 and Prakas No. 033.
- Prakas No. 008 applies to all types of elevators used in building construction and non-building construction. It stipulates, among others, the conditions for the use of elevators and the formalities for the issuance of a certificate of elevator use. It also outlines the procedure for the application of a certification letter of elevator safety and quality, as well as the penalties for non-compliance.
- Prakas No. 033 applies to all types of elevators, except those used at construction sites. It provides for the classification of licences, the conditions for the issuance of a licence for elevator installation, and the formalities for the issuance of the same. It also sets out the formalities for the application of a licence for elevator installation by foreign entities and professionals, and the penalties for non-compliance.
