Rajah & Tann Singapore Partners Contribute to Four Chapters of Singapore Academy of Law Annual Review of Singapore Cases

Our Partners have contributed four chapters to the Singapore Academy of Law Annual Review of Singapore Cases (“SAL Ann Review“). The SAL Ann Review is an annual publication that encapsulates key Singapore cases and regulators’ decisions in an array of areas of law in the preceding year. Its contributors comprise leading practitioners and academics who review and analyse these cases and decisions.

  • Admiralty and Shipping Law: Senior Partner Toh Kian Sing, SC from the Shipping & International Trade Practice contributed the admiralty law section of the chapter, focusing on four salient admiralty judgments in 2024. These include one decision by the Court of Appeal on the importance of choice of forum in resolving maritime disputes.
  • Insolvency Law: Partners Sim Kwan Kiat, Wilson Zhu and Raelene Pereira from the Restructuring & Insolvency Practice reviewed decisions in 2024 that have shaped the legal landscape in restructuring and insolvency. These include decisions on avoidance of transactions, directors’ duties when companies approach insolvency, schemes of arrangement, and latest principles on the application of the UNCITRAL Model Law for Cross-Border Insolvency in Singapore.
  • Competition Law: Kala Anandarajah, BBM, Head of the Competition & Antitrust and Trade Practice, highlighted the Competition and Consumer Commission of Singapore’s (“CCCS“) key decisions in 2024, including those relating to: (i) anti-competitive agreements, cartel and collusion; (ii) mergers that could reduce market competition; and (iii) consumer protection. These decisions demonstrate CCCS’ increased commitment to enforce the Competition Act 2024 and the Consumer Protection (Fair Trading) Act 2003 in the relevant year across various sectors including aviation, transportation, and technology. This chapter is recommended reading for businesses seeking to stay updated on CCCS’ enforcement efforts so they will not run afoul of competition and consumer protection legislations and issuances.
  • Insurance Law: Simon Goh and Wang Ying Shuang, Head and Deputy Head of the Insurance & Reinsurance Practice, respectively, reviewed a significant Magistrate Court’s decision in 2024 which dealt with the right of contribution in double insurance cases, i.e. where one is insured against the same risk under two separate insurance policies issued by two insurers.
