Alvin has been a member of the firm’s Dispute Resolution practice group since joining in 2013.
He has developed extensive experience across a wide range of litigation, mediation, and arbitration matters. His work includes drafting statements of claim and other pleadings before the District Court, High Court, and Supreme Court, as well as preparing legal opinions, memoranda, and various legal documents related to dispute resolution.
With a strong interest in arbitration, Alvin has been involved in both domestic and international proceedings under SIAC, ICC, UNCITRAL, BANI, and LAPS SJK rules. He is also an active member of the Young SIAC committee and has completed advanced arbitration training programs offered by institutions such as CIArb, ICC, and IARBI.
In addition to dispute resolution, Alvin advises on restructuring and insolvency matters and has served as counsel in high-profile cases, including the PKPU process of Garuda Indonesia. He is a registered bankruptcy receiver and PKPU administrator. His practice also extends to advising on government contracts, anti-corruption, and anti-money laundering compliance, and he has contributed to legislative developments on issues such as ultimate beneficial ownership (UBO) disclosure and reporting obligations for practicing lawyers.
Alvin earned his law degree from Universitas Indonesia in 2011 and obtained his LL.M. from the University of Pennsylvania Carey Law School in 2022, with the support of a full-tuition scholarship from the Indonesia Endowment Fund for Education (LPDP).
EXPERIENCE
- Successfully represented a hotel company (“Client”) in a BANI arbitration against a leaseholder who alleged breaches under a Management Agreement related to the operation of a condotel unit in Bali. The arbitral tribunal ruled in favor of our Client, strengthening AHP’s portfolio in tourism-related disputes.
- Represented a state-owned construction enterprise in an arbitration case under ICC rules, involving a subcontractor dispute over a dredging and supply works agreement. The tribunal ultimately ruled in our client’s favor, awarding just 10.5% of the amount claimed.
- Successfully represented an Indonesian insurance/reinsurance company (“Client”) in a IDR11.9 billion dispute over a reinsurance contract under SIAC Arbitration Rules. The dispute arose after a reinsurer rejected the Client’s claim, citing alleged breaches, but we secured a favorable arbitral award granting full coverage, plus interests and costs.
- Acted for PT Garuda Indonesia (Persero) Tbk (“GIAA”) as its Indonesian legal counsel in the restructuring of all its financial and trade debts and aircraft leases, as well as its business transformation. We represented GIAA in its suspension of debt payment obligation (“PKPU”) proceedings submitted by its trade creditor. We are involved in the discussions between GIAA and its stakeholders, including creditors, lessors, and the Indonesian Ministry of State-Owned Enterprise (“SOE”) and Ministry of Finance regarding the proposed restructuring plan. We assisted GIAA in the implementation of the court sanctioned composition plan. In addition, we also assisted international counsels in Garuda’s defense in several insolvency related cases and recognition of the PKPU proceeding and composition plan in various jurisdictions, namely Australia, France, Singapore, the USA. This the largest SOE restructuring case in Indonesia to date. This deal won several awards, including “Impact Case of the Year” from Benchmark Litigation Asia Pacific Awards 2022 and “Deal of the Year: Restructuring” from IFLR Asia Pacific Awards 2023.
- Acted for PT Waskita Karya (Persero) Tbk as legal counsel in the proposed restructuring of its financial debts and obligations. Waskita’s restructuring process has dated back to 2021, with an outstanding debt amounting to IDR29.3 trillion which has been restructured through a Master Restructuring Agreement.
- Assisted a prominent Malaysian company in the plantation industry, in providing a legal memorandum regarding the revocation of a lawsuit in a dispute over a sale and purchase agreement for palm oil plantations owned by its subsidiaries.
- Successfully defended PT Tokopedia in a civil lawsuit regarding data privacy and consumer protection before the district court.
- Represnted PT Garuda Indonesia (Persero) Tbk in a lawsuit against Rolls Royce Plc and its subsidiary to cancel the Total Care Agreement and claim IDR 640.94 billion in damages due to alleged fraud. The matter drew significant public attention following Rolls Royce’s admission of corrupt practices in a 2017 deferred prosecution agreement with the UK Serious Fraud Office. We assisted the Client in court proceedings, settlement negotiations, and provided legal advice related to the agreement.
- Represented AEON Mall Indonesia as a creditor in the PKPU proceedings of PT Sentul City Tbk in connection with the recovery of outstanding liabilities.
- Represented Ir. H. Joko Widodo as a defendant in an unlawful act lawsuit before the Tanjungkarang District Court concerning the development of the Trans Sumatra Toll Road.
- Represented Jakarta Industrial Estate Pulogadung in the restructuring of its financial obligations through a PKPU process involving total debts of approximately USD4.5 million.
- Represented an airport operator as the claimant in a BANI arbitration concerning an insurance claim, with a dispute value of approximately USD11.8 million.
- Represented a pharmaceutical company as the respondent in a SIAC arbitration arising from a dispute related to a distribution agreement.
