Novel issues raised relating to arbitrations involving disputes arising under contracts of affreightment (COA)

Acting for a subsidiary of YTL Cement Bhd, Malaysia in 2 related SCMA arbitrations involving disputes arising under contracts of affreightment (COA’s) entered into by the client with a Hong Kong party (the Claimant) to engage vessels for the shipment of clinker and cementitious products to and from various ports in Malaysia and Singapore. The COA’s involved a series of continuous voyage charters of the vessels provided by the Claimant for the carriage of the cargo.

Total claims in both arbitrations amount to around US$10 million.
