Landmark Case on Ratification of Contracts

Successfully represented the respondents in a landmark case before the Court of Appeal in Alternative Advisors Investments Pte Ltd v. Asidokona Mining Resources Pte Ltd anor [2024] SGCA 3. The apex Court ruled that the purported ratification of certain loan documents and deeds of assignment was invalid, as the agent did not and could not have purported to act on behalf of the principal. This case (and the Appellate Division decision in which the Rajah & Tann Singapore team was also successful) illustrates the complexities and nuances of contract law and the parameters of agency in commercial transactions.

Partner Gregory Vijayendran SC led the case together with Partner Lester Chua and Associate Tomoyuki Lewis Ban, from the Commercial Litigation practice.
