Advising on employment performance issues in relation to Mental Health Act

The firm assisted the client in respect of an employee with behavior and performance issues who has claimed a mental health condition.

This matter is significant because the Mental Health Act is a relatively new legislation and there is little precedence on what an employer needs to do when an employee who is the subject of a potential disciplinary process has made allegations of mental health issues, and because of the steep penalties under the law.
